Urgent: Obama Eligibility question Friday: December 12, 2008 Shalom in Christ Jesus, As I have stated previously, I have a real distaste for covering politics. For the most part they are just a distraction from the more important works that we should be about while it is still 'light'. However, in this case I find it necessary to continue cover this issue as the nearly complete disregard on the part of the US populace, media and Judiciary is symptomatic of the much deeper spiritual stupor this country finds herself in an shows the general spirit of lawlessness that has overtaken America. What is without a doubt the most appalling yet expected has been the complete lack of coverage from the mainstream media. Even FOX News and CNN's Lou Dobbs' seem to be avoiding this issue like the plague and when a newspaper does pick it up they typically sound more like the official propaganda office of the Obama campaign rather than the free press and government watchdog they were originally designed to be. Most ridiculous is The Associated Press again running their now standard "conspiracy theory" piece concerning this issue. I want readers to really think about this and consider what the propaganda machines are trying to do. What is the conspiracy here? There is no conspiracy nor has any conspiracy been charged by anyone. The only claims anyone has made is that Barack Obama was not thoroughly vetted by the Democratic National Committee, making sure he was eligible as a candidate and that if he is not a 'natural born citizen' as the US Constitution clearly states, then he is not eligible to be president. What conspiracy is this? And yet, the "conspiracy theory" card is played because this has become the modern way to 'blacklist' any topic that is not supposed to see the light of day. Frankly, I am so disgusted and sickened by the arrogant press in this country and cannot help but be pleased at all the financial trouble the media giants are facing. Even the 'Flag-Ship' newspaper for the parent company I work for, The Newark Star-Ledger owned by Advance/Newhouse has considered dropping The Associated Press due to their extreme cost and published an entire newspaper in September without one AP story. In just this past week, there have been numerous articles of newspapers going up for sale due severe drops in ad revenue and circulation. Reader comments written concerning these articles nearly all say the same things; that these readers are sick of the extreme liberal bias in the media and sick of being told what the news is rather than just having it reported. Yet, when the arrogant editors respond, all they can do is blame the very readers they still have. I do not doubt for a moment that we are seeing financial judgment fall upon these news organizations for their blatant bias against Israel, hatred of Christians, anti-Christian reporting and the twisting of truth for for the purpose of propaganda for years on end. Yet, it seems that many more people do not want to be distracted by truth or facts. Here are just a couple of the comments I have faced within the past few days. One fellow worker and Obama supporter commenting on the ongoing Obama eligibility saga said flat out that, "he didn't want to hear anything about it". In the past, this same person has stated that, "if truth is negative, then it is not good and must not necessarily be excepted." Another person at my place of employment who is a big Obama supporter was describing how during the campaign the 'right-wing' would use anything to try to make Obama look bad. He then said how he could not believe they were even calling him a "socialist" only to immediately follow up his statement with the fact that he still had not found out what a socialist was. This is a perfect example of the pathetic and 'dumbed down' state of an overwhelming majority of Americans. They have been taught for years to 'think' with their emotions while they have no real understanding of issues or ability to search them out. If you try to reason with them, you find they are incapable of reason and can only emote. America is perilously teetering on the brink of social and economic collapse. Despite electing it's first African American president, racial and ethnic tensions are at an all time high and although I am very concerned about the total disregard for the Constitution surrounding this election, if it were to be overturned (which I highly doubt would happen) I fear all out anarchy and civil unrest would break out and martial law would have to be declared. Lastly, I have wrestled with WorldNet Daily's letter writing campaign both to the US Supreme Court and to the Electoral College because after looking over the facts I believe it muddled the issue. WORLDNETDAILY - Exclusive commentary by Alan Keyes - December 4, 2008 The events that mark the end of one form of government and the beginning of another are more easily perceived and understood in the aftermath than by those caught up in the events and circumstances that constitute the transformation. The passions and affections of the moment interfere with the detachment that makes it possible for the mind to see the true significance of issues and decisions. Some things that seem large and momentous are in fact the exaggerated mirages of transient passion; others dismissed as sideshows will be seen in retrospect as crucial to the main event. At the moment, these different possibilities may be ascribed to the same occurrence. A great storm of interest and celebration rages at the prospect of the first "African-American" president, and the supposed implications of his election as a breakthrough in the history of "race" relations in the United States. Yet, because it centers on a man who has in his background and character no ties to the actual people and events of that history, historians will have to look elsewhere for the event that truly represents the denouement of the story whose greatest turning point remains the first American Civil War. By contrast, scant attention is being paid to the unfolding constitutional drama, also connected with his inauthentic personal history, even though it clearly represents a potentially fatal crisis for the regime of constitutional, democratic self-government that has heretofore determined the government of the United States. Until now, the government of the United States has been a constitutional republic based on the sovereignty of the people. The Constitution of the United States, as the ultimate and permanent expression of that sovereignty, has been respected as the Supreme Law of the Land. Some people, myself included, would certainly argue that in some matters this respect has been a merely formal camouflage for actions and decisions that contradict, embroider or simply ignore the plain text of the Constitution, but until now this has been done with arguments (however groundless and illogical) that formally preserve its authority. Now a question has arisen with respect to what may be in a practical sense the most critical allocation of power in the Constitution, that of the president of the United States. Though by election that power is in the gift of the American people, the Constitution clearly imposes two restrictions or conditions upon it. It cannot be extended to someone under 35 years of age. It cannot be given to anyone who is not a natural born citizen of the United States. Evidence has emerged, including recorded statements by his Kenyan grandmother, that raise doubts as to whether Barack Obama is in fact a natural born U.S. citizen, eligible to be president. Whatever the facts are, there can be no doubt of the constitutional requirement, and no doubt that a conscious decision to ignore it involves open and destructive disregard for the Constitution' s authority. If Obama is accepted as president of the United States in a context that sets aside the Constitution of the United States, by what authority will he govern? Relying on the results of the recent election, some will say "by the authority of the people," which is to say the majority of the people which elected him. But until now, the United States has not been simply a democratic republic (that is, a regime in which the sovereign power follows the will of the simple majority) but a constitutional democratic republic (in which the sovereign power follows the will of the constitutional majority, and is bound by the terms and conditions specified in the Constitution. ) The best illustration of the difference may be taken from the very history Obama's election is supposed to culminate - the history of black Americans. In 1954, when the Supreme Court announced its opinion in the famous Brown v. Board desegregation case, the simple majority of the American people had repeatedly and continuously accepted or tolerated segregation, both in their election of representatives and in the legislation passed by those representatives. The Court held segregation to be contrary to the Constitution (the Supreme Law of the Land) and therefore unlawful. Its authority to do so rests on the clear logic of judicial review succinctly articulated by Alexander Hamilton in the Federalist Papers: A constitution is, in fact, and must be regarded by the judges, as a fundamental law. It therefore belongs to them to ascertain its meaning, as well as the meaning of any particular act proceeding from the legislative body. If there should happen to be an irreconcilable variance between the two, that which has the superior obligation and validity ought, of course, to be preferred; or, in other words, the Constitution ought to be preferred to the statute, the intention of the people to the intention of their agents. Nor does this conclusion by any means suppose a superiority of the judicial to the legislative power. It only supposes that the power of the people is superior to both: and that where the will of the legislature, declared in its statutes, stands in opposition to that of the people, declared in the Constitution, the judges ought to be governed by the latter rather than the former. They ought to regulate their decision by the fundamental laws, rather than by those which are not fundamental. (Federalist 78) Though the results of any given election also represent the will of the people, the validity of those results rests on the substantive and procedural understanding arrived at by the people and expressed in the provisions of the constitutional compact. In it, the people have agreed that, first in its adoption and then in the adoption of any changes in its terms, a more comprehensive majority is required than that which decides the outcome of any other election prescribed by it. The need for this more comprehensive majority makes the Constitution a more permanent and durable expression of the will of the people than any subsequent action by a simple majority. In this context, those who compose the simple majority are, like the members of the legislature, subordinate agents of the constitutional majority. Almost all the great advances of the civil rights cause in the 20th century depended upon this argument as to the authority of the Constitution. The concept of constitutional review has also been crucial in the protection of individual rights, including the property rights of those who might otherwise be despoiled by intemperate majorities, roused to injustice by ambitious demagogues. If Barack Obama is allowed to assume the office of president without positively establishing his eligibility under the Constitution, it will set a precedent for exempting the allocation of executive power from constitutional restrictions on the pretext that majority support overrules constitutional authority, popularity supersedes the fundamental law. Obviously, this is a recipe for the establishment of democratic dictatorship, like that which characterized the revolutionary first republic in France and licensed its murderous excesses. It is the counterpart of the "democratic people's republics" in whose name countless millions were imprisoned and killed by oppressive party dictatorships in the Soviet Union, Communist China, North Korea, etc. In an era when the insecurity implied by the threat of terrorist attack already overshadows our liberties, only one thing may be more dangerous to our freedom than such a precedent - the fact that it comes about because of the ignorance, fear, or selfish ambition of those sworn to uphold the Constitution. If they lack the character to do so now, before abuses of executive power create an environment of physical fear and intimidation, what must we expect once those abuses produce their inevitable effect? The people mesmerized by his tinsel rhetoric may expect Obama to resist the temptations of demagogic tyranny, but if he assumes office knowing that in doing so he has already successfully set aside the Constitution, no reasonable person could agree with them. As Shakespeare wrote, "Things bad begun make strong themselves by ill." ("Macbeth," Act 3, Scene 2) Since every government official in the United States is sworn to uphold the Constitution, all of them, at every level, have a positive obligation to make sure its provisions are implemented. With regard to the issue of Obama's eligibility to serve as president, a special responsibility falls upon the Supreme Court of the United States. Though in the end, the actual implementation of the Constitution must at this stage be left to the members of the Electoral College (who will also be bound by oath to respect the Constitution) , the Supreme Court has the duty that falls to the judiciary in every case, to make sure the provisions of the law are clearly understood, and that relevant facts are presented and have not been falsified or fraudulently withheld. Since the case involves a general election, in which millions of citizens participated, prudence dictates that this be done in a way that assures those millions that the law has been respected, which means that relevant facts and evidence must be publicly presented to the fullest extent possible. A failure of statesmanship in this matter could obviously have the gravest consequences. It would be inexcusable dereliction to permit a situation in which the putative authority of a sitting president is plainly contradicted by the authority of the Constitution from which the whole government derives its legitimacy. Citizens, sworn officials of government at every level, members of the military - all would be put in a position where their sworn duty to the Constitution is in opposition to their inclination to respect the decisions and actions of the president of the United States. Both intellect and conscience recoil at the prospect of such conflicting claims. I pray that the justices of the Supreme Court, and other officials sworn to uphold the Constitution, will do and be seen to do their duty. Otherwise Obama's vaunted promise of change will portend the demise of America's peaceful liberty. The action came in a case brought to the high court by Philip J. Berg, who alleges Obama is ineligible to be president. Berg had asked the court for an injunction the stay the Electoral College votes and prohibit Vice President Dick Cheney, the House of Representatives and the U.S. Senate from counting any votes until that demanded proof arrives. The injunction was sought while Berg awaits the court's determination on whether it will hear his writ of certiorari requesting review of a dismissal of his case in U.S. District Court in eastern Pennsylvania. "I know that Mr. Obama is not a constitutionally qualified natural born citizen and is ineligible to assume the office of president of the United States," Berg said in a statement on his ObamaCrimes. com website. "Obama knows he is not 'natural born' as he knows where he was born and he knows he was adopted in Indonesia; Obama is an attorney, Harvard Law grad who taught Constitutional law; Obama knows his candidacy is the largest 'hoax' attempted on the citizens of the United States in over 200 years; Obama places our Constitution in a 'crisis' situation; and Obama is in a situation where he can be blackmailed by leaders around the world who know Obama is not qualified," Berg's statement continued. However, the high court, in a terse website entry, confirmed the application for the injunction was "denied by Justice [David] Souter." The controversy, however, remains far from over. The latest ruling was sandwiched between Monday's decision not to review arguments against Obama's candidacy in the Donofrio v. Wells case from New Jersey and a conference that is scheduled by the justices this Friday on another case raising virtually the same concerns. The case brought by Leo Donofrio alleged Obama does not meet the Constitution' s Article 2, Section 1 "natural-born citizen" requirement for president because of his dual citizenship at birth, as does the new case, Cort Wrotnowski v. Susan Bysiewicz, Connecticut secretary of state. The Wrotnowski case had been rejected by Justice Ruth Ginsburg Nov. 26, but then was resubmitted to Justice Antonin Scalia. There was no word of its fate for about 10 days, then the court's website confirmed it has been distributed for this Friday's conference, a meeting at which the justices consider whether to take cases. More than a dozen cases have been brought into various courtrooms over Obama's eligibility, many of which have been dismissed summarily. However, others still remain in the pipeline that could lead to the U.S. Supreme Court. - - - - Read Full Report Electors challenged to investigate birth dispute 'Only reasonable explanation' is he wasn't born in the U.S. WORLDNETDAILY - December 11, 2008 An activist organization has posted a video on YouTube challenging members of the Electoral College to investigate the dispute over Barack Obama's birth certificate and eligibility for office. The U.S. Constitution requires that the president be a "natural born" citizen, but the organization, Democratic-Disaster .com, says instead of providing the documentation, Obama has hired three law firms to make certain the public does not have access to it. That's where the electors come in, according to the organization. The group says they have the "moral and constitutional obligation" to investigate and be assured of Obama's eligibility. According to a newspaper report, Hawaiian Judge Bert Ayabe has dismissed a suit filed by one Andy Martin, on the ground that Martin "does not have a direct and tangible interest in the vital statistic records being sought, namely the birth certificate of President Obama." Perhaps one may gauge the circumspection and even-handedness with which Ayabe approached the case by recalling that Barack Obama is not yet "the President of the United States," only the ostensible "President elect" once removed (because he has been purportedly "elected" only by the voters, but not yet by the Electoral College as certified by the President of the Senate under the Twelfth Amendment). And the underlying issue in Martin's suit is whether Obama is even constitutionally eligible to hold the Office of President. So Ayabe's decision exhibits a rather strong undercurrent of question-begging and special pleading. In a like vein, Ayabe ruled that Martin was not among the set of individuals to whom Hawaiian law grants a right to inspect birth certificates. Of course, the more important inquiry is whether the restraints Hawaiian law imposes generally on public inspection of the State's records must yield to an implied cause of action under the Constitution of the United States for any American citizen to establish whether or not Barack Obama in particular is even "eligible to the Office of President" now that his status as a "natural born Citizen" has been (and is being repeatedly) challenged. [See Article II, Section 1, Clause 4 and Article VI, Clause 2] Worse yet, Ayabe scored Martin for failing to prove that "irreparable harm will occur if the records are not provided." Perhaps neither Martin nor Ayabe has read my previous article, "Obama Must Stand Up Now or Step Down," which outlines only some of the more obvious "irreparable harm" that must ensue if an usurper seizes control of the Presidency. But one would hope that a "judge" might have some independent familiarity with the Constitution sufficient to lead him on his own to the correct conclusion. NINA MITCHELL WELLS, SECRETARY OF STATE OF THE STATE OF NEW JERSEY - US Supreme Court Docket # 08A407 - continues to be subjected to misconduct by the US Supreme Court Clerk's office, particularly by Mr. Danny Bickell, the Stay Clerk. For a full review of the Judicial treachery in this case, please review the entire UNORTHODOX PROCEDURAL HISTORY of the case. It has come to my attention today that the US Supreme Court's Stay Clerk, Mr. Danny Bickell, has continued to list this case incorrectly thereby preventing it from ever crossing the desk of Justice Clarence Thomas. The Docket of the case fails to mention that the case went directly from the Appellate Division in New Jersey to the New Jersey Supreme Court which is the nexus that allows the case to be properly before the US Supreme Court. The Clerk's office appears to be doing everything possible to see that this case never gets to the desk of Justice Clarence Thomas or any of the other Supreme Court Justices. I have an order handed down from the New Jersey Supreme Court which makes reference to the Appellate Division case as well, but the US Supreme Court Clerk's office refuses to acknowledge the NJ Supreme Court's review and it is that review which allows my case to go before the US Supreme Court. The Appellate Division case avoided the Constitutional issue, but the NJ Supreme Court decision raised the Constitutional issue when it specifically said in its order of denial that it had relied on "movant's papers" while at the same time it made no mention of Judge Sabatino's Appellate Division order and opinion. The NJ Supreme Court specifically relied upon "movant's papers" in their order denying emergency relief and "movants papers" focused on the "natural born citizen" issue. Here is the decision of the Honorable Justice Virginia A. Long: "This matter having come before the court on an application for emergent relief pursuant to Rule 2:9-8, and the undersigned having reviewed the movant's papers and the papers filed by the defendant in the Superior Court, Appellate Division, it is hereby Ordered that the application for emergent relief is denied." The US Supreme Court Docket fails to mention the NJ Supreme Court decision and that is completely wrong and improper. This case continues to be subjected to Judicial/Clerical misconduct and it's time that US Citizens, be they Democrat, Republican or 3rd party affiliated, stand up and order that the Clerk's office of the highest Court in the land STOP interfering in a case that is rightly before the US Supreme Court. This is unprecedented in that the Clerk's office at the SCOTUS appears to be injecting politics into the handling of paperwork properly before it. It will be a terrible blow to the separation of powers if Supreme Court review can be stopped by Clerks imposing their own political views on litigants who have properly followed legal procedure. Let me focus on Leo Donofrio's lawsuit which I covered in Part II of my last column. Leo is asking you to please write a short letter to Justice Clarence Thomas now that his case is docketed. You need only ask Justice Thomas to hear Leo's case on an expedited basis because Obama's refusal to prove he's a natural born citizen is building into a constitutional crisis that cannot be allowed to progress to the swearing in process should the electoral college actually go ahead and vote him in on December 15, 2008. As a Kenyan native, Barack Obama Sr. was a British subject whose citizenship status was governed by The British Nationality Act of 1948. That same act governed the status of Obama Sr.'s children. "Since Sen. Obama has neither renounced his U.S. citizenship nor sworn an oath of allegiance to Kenya, his Kenyan citizenship automatically expired on Aug. 4,1982." That is a direct admission Barack Obama was a British citizen "at birth". "My law suit argues that since Obama had dual citizenship "at birth" and therefore split loyalties "at birth", he is not a "natural born citizen" of the United States. A "natural born citizen" would have no other jurisdiction over him "at birth" other than that of the United States. The Framers chose the words "natural born" and those words cannot be ignored. The status referred to in Article 2, Section 1, "natural born citizen", pertains to the status of the person's citizenship "at birth". "The other numerous law suits circling Obama to question his eligibility fail to hit the mark on this issue. Since Obama was, "at birth", a British citizen, it is completely irrelevant, as to the issue of Constitutional "natural born citizen" status, whether Obama was born in Hawaii or abroad. Either way, he is not eligible to be President. Should Obama produce an original birth certificate showing he was born in Hawaii, it will not change the fact that Obama was a British citizen "at birth". "Obama has admitted to being a British subject "at birth". And as will be made perfectly clear below, his being subject to British jurisdiction "at birth" bars him from being eligible to be President of the United States. "As I have argued before the United States Supreme Court, the 14th Amendment does not confer "natural born citizen" status anywhere in its text. It simply states that a person born in the United States is a "Citizen", and only if he is "subject to the jurisdiction" of the United States. "Article 2, Section 1, Clause 5 of the Constitution of the United States: "No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty-five Years, and been fourteen Years a Resident within the United States." "The most overlooked words in that section are: "...or a Citizen of the United States, at the time of the Adoption of this Constitution. .." You must recall that most, if not all, of the framers of the Constitution were, at birth, born as British subjects. "Stop and think about that. "The chosen wording of the Framers here makes it clear that they had drawn a distinction between themselves - persons born subject to British jurisdiction - and "natural born citizens" who would not be born subject to British jurisdiction or any other jurisdiction other than the United States. And so the Framers grandfathered themselves into the Constitution as being eligible to be President. But the grandfather clause only pertains to any person who was a Citizen... at the time of the Adoption of this Constitution. Obama was definitely not a Citizen at the time of the adoption of the Constitution and so he is not grandfathered in. "And so, for Obama or anybody else to be eligible to be President, they must be a "natural born citizen" of the United States "at birth". It should be obvious that the Framers intended to deny the Presidency to anybody who was a British subject "at birth". If this had not been their intention, then they would not have needed to include a grandfather clause which allowed the Framers themselves to be President. "The Framers recognized that even they were not "natural born citizens" and so they wrote the grandfather clause in to allow any of them to become President. But the grandfather clause only pertains to those who were Citizens at the time of the Constitution' s adoption. And so, Barack Obama is not a "natural born citizen" of the United States and neither is John McCain who was born in Panama, and neither is Roger Calero who was born in Nicaragua." The actual text of the letter they are sending is fine, but the article which solicits participation is incorrect. Here is what it says: "...there is only one way to make your voice heard in time for Friday's preliminary hearing - overnight delivery of your letter. Join more than 145,000 others in signing WND's online petition calling for release of Barack Obama's birth certificate and verifying beyond any shadow of a doubt his constitutional eligibility for office. This offer ends Thursday at noon Eastern Time to ensure all letters are delivered by Friday morning to the Supreme Court." That language is just awful. No birth certificate can "verify beyond a shadow of a doubt his constitutional eligibility for office." Please. WND is basically saying that if Obama shows an original BC, then his is eligible beyond a shadow of doubt. That is is false. I have REPEATEDLY stated that Obama can release a golden birth certificate signed by 100 gazzillion witnesses embossed in gold leaf that he was born on the mall in Washington DC and it still wouldn't make him a "Natural Born Citizen" under the Constitution because he was, regardless of where he was born, a BRITISH citizen "at birth." Since he was "born" as a British citizen/subject, his United States citizenship was not "natural". World Net Daily has done a prior article where they did get it right, but at this crucial moment, two days before the SCOTUS meets, they are getting it wrong. The article goes on to say: "Farah launched a petition drive on WND two weeks ago that calls on all controlling legal authorities to ensure the Constitution is followed on the question of eligibility and for full public disclosure of the facts of Obama's birthplace and parentage... " There is no dispute about Obama's parentage. His father was a British Citizen, and his mother was a United States citizen. Therefore, Obama was both a subject/citizen of the British monarchy as well as a United States citizen "at birth". His place of birth won't change that no matter where he was born. The WND letter solicitation fails to point that out and as such is doing harm to public awarenesss. Here's why: if Obama produces a genuine vault kept birth certificate from Hawaii that satisfies every possible requirement, many people will be under the mistaken impression that he is a natural born citizen. World Net Daily needs to correct that solicitation and let its readers know that Obama is not eligible regardless of where he was born. These are some of the thoughts going through my mind as I sit in bemusement at the prospect of the swearing in and inauguration of the next president two months from now - when a president-elect (assuming the Electoral College gives him the same kind of free pass election authorities and my colleagues in the "watchdog press" have given him to date) takes over the leadership of the executive branch of government. There's just two months left before we witness one of the gravest attacks ever on the literal meaning of the U.S. Constitution. Isn't it fitting that a so-called "constitutional scholar" - a former law professor - will be the one to deliver this fateful blow? At that point, those who subscribe to the theory that we have a "living Constitution, " one that means different things to different people at different times in history, will have experienced their crowning achievement - the induction of a president whose very eligibility for the office is questioned by millions of Americans who are told they don't have any standing in courts to demand actual proof. Supreme Court to Uphold or Ignore the Constitution?

The founders stated very simply, "The judicial Power of the United States, shall be vested in one supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish. Article II - Section I establishes who is eligiable to run for President of the United States, "No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty-five Years, and been fourteen Years a Resident within the United States." Respected author and journalist Joan Swirsky, chronicles the numerous legal challenges to Barack Obama's constitutional eligibility in her November 24th column, The Great Birth Certificate Scandal-Cover-Up of the 2008 Election. A story buried by the entire American press corps for months now, in their effort to seat their "global messiah." As Swirsky states in her column, "Leo C. Donofrio a retired attorney, started a website (supporting link) and filed a suit in New Jersey on November 3, asking Secretary of State, Nina Mitchell Wells, for an emergency stay prohibiting Obama, Sen. McCain, and Socialist Worker's Party candidate Roger Calero, from appearing on New Jersey's ballot, claiming all three are not "natural born citizens." On Nov. 6, Supreme Court Justice David Souter denied Donofrio's application. But the case has now entered the docket of the U.S. Supreme Court and Justice Clarence Thomas has decided to send it to conference on December 5th! This means that only 10 days before the Electoral College votes, the nine Justices of the U.S. Supreme Court will meet privately to discuss Donofrio's case." As of this writing, December 6th, the Supreme Court has not yet announced whether or not it will take up the Donofrio case, or any other case concerning Obama's constitutional eligibility for the office of President. Yet there is no more important issue before the court today and the clock is ticking. Upholding the Constitution After the "hanging chad" debacle of 2000, the court is undoubtedly reluctant to weigh in on the eligibility of a presidential candidate which, appears to have won the 2008 general election by more than a 7 million vote margin. But he is not elected until he is elected by the Electoral College. He is not president until he is sworn into office by the Chief Justice of the Supreme Court, despite his efforts to create unconstitutional power in the nonexistent office of "President-Elect." However, the court is not bound by public popularity. It is instead bound by it's obligation to protect, defend and uphold the U.S. Constitution and allowing an ineligible candidate to be sworn into the highest office in the land would be the greatest affront to constitutional law in U.S. history. It would be a complete failure of the court, not to mention a complete failure of the Constitutional Republic as a whole. If the Supreme Court refuses to take up the issue of Obama's eligibility, which is indeed in reasonable doubt as evidenced by numerous legal challenges filed across the country, the court will be demonstrating that when push comes to shove, they are not willing to execute their primary function of upholding the people's charters of freedom. They will have rendered themselves irrelevant. Beyond any Reasonable Doubt On the other hand, it is in the best interest of the nation, the court, the people's charters of freedom and even the incoming Obama administration, to settle the issue of Obama's constitutional eligibility before allowing the Electoral College to cast votes for a candidate whose fundamental eligibility is in such serious doubt. Make no mistake, Obama supporters have been quite clear about their position on the matter. They do not care whether or not Obama is constitutionally eligible for the office he seeks. The fact is, Obama supporters have demonstrated throughout the campaign that they are not in the least impressed by facts, laws, or the constitution. They want what they want, even when they don't know what that is, and don't know if it's even legal or not. But the rule of constitutional law must prevail regardless of political ambitions, because the republic itself will fall without the rule of constitutional law. If I were Obama, or even an Obama supporter, I would want no such cloud hanging over my administration. The notion that Obama can unite the nation is beyond silly when half of the nation believes he is wholly ineligible even to seek the office of president. The Supremes It's quite telling that the average Obama supporter is willing to grant the court the authority to alienate the unalienable rights to Life, Liberty and Happiness, but accuses the court of "overstepping its boundaries" any time the court steps in to uphold the constitution, as it did in the 2000 election debacle. The court has a fundamental obligation to uphold the constitution without political bias. It has failed to meet this obligation several times in the past, at great cost to the American people and their republic. But this time, if the court fails to meet its primary obligation, the court will render the entire foundation of this nation moot. If the constitutional requirements for the highest office in the land are no longer to be upheld, nothing in the constitution is to be upheld. The entire document will be rendered no more valuable than an outhouse copy of a Sears catalogue. Rumor has it that the Supreme Court of the United States will announce its intentions regarding the Obama eligibility matter sometime Monday the 8th. For the sake of the constitutional republic itself, I hope they make the right decision. I dare not imagine the state of the union without its constitutional foundation. Obama could have ended this discussion at any time over the last two years, by simply offering the "transparency" he based his campaign rhetoric upon. He has instead, spent over a half-million dollars in legal fees attempting to subvert the constitution and run the clock out before facing the matter. As a result, the Supreme Court is now in the uncomfortable position of being the last line of defense and it must act to protect and uphold the constitution, or there will be nothing left to protect and defend from hereafter. A Matter of Precedent As the high court now has a long history of "making law" via judicial activism and precedent setting by way of court decisions, it is vital to America's future that the correct precedent be established in the Obama eligibility for office case. Imagine a Supreme Court precedent that allows any citizen of any foreign nation to hold the office of President of the United States. This matter is much bigger than Barack Obama and the ultimate outcome of the 2008 election. By its actions (or inaction) in the pending Obama cases, the court will establish one of two precedents. The constitutional requirements for President must be upheld even in the case of Barack Hussein Obama and his 66 million supporters... Or, it can not be used to prevent a President Soros or Ahmadinejad in the future. In short, the U.S. Constitution either matters today, or it doesn't matter ever again. That's what the Obama case is all about and this is why the Supreme Court must decide whether it is a court of politically motivated public opinion, or a court of equal justice under Constitutional Law. Who Wrote Dreams From My Father?

Prior to 1990, when Barack Obama contracted to write Dreams From My Father, he had written very close to nothing. Then, five years later, this untested 33 year-old produced what Time Magazine has called -- with a straight face -- "the best-written memoir ever produced by an American politician."

The public is asked to believe Obama wrote Dreams From My Father on his own, almost as though he were some sort of literary idiot savant. I do not buy this canard for a minute, not at all. Writing is as much a craft as, say, golf. To put this in perspective, imagine if a friend played a few rounds in the high 90s and then a few years later, without further practice, made the PGA Tour. It doesn't happen.

And yet, given the biases of the literary establishment, no reviewer of note has so much as questioned Obama's role in the writing, then or now. As the New York Times gushed, Obama was "that rare politician who can write . . . and write movingly and genuinely about himself." These accolades matter all the more because Obama has built his political persona around his presumably superior intellect, Dreams being exhibit A.

Shy of a confession by those involved, I will not be able to prove conclusively that Obama did not write this book. As shall be seen, however, there are only two real possibilities: one is that Obama experienced a near miraculous turnaround in his literary abilities; the second is that he had major editorial help, up to and including a ghostwriter.

Then Jerry Titus had joined a group on Facebook and had invited me. So now I know a little bit more about it, but my brain's been foggy so I don't understand the whole thing.
